Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and PostZen Inc. ("PostZen," "we," "us," or "our") governing your access to and use of the PostZen platform, including our website, applications, and related services (collectively, the "Service").

By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the Terms, you may not access the Service.

Description of Service

PostZen is a social media management platform that enables users to:

• Create, schedule, and publish content to multiple social media platforms
• Generate AI-powered content suggestions and captions
• Monitor and respond to social media engagement
• Analyze performance metrics and generate reports
• Collaborate with team members on social media content
• Manage multiple social media accounts from a single dashboard

Account Registration and Security

To use certain features of the Service, you must register for an account. When you register, you agree to:

• Provide accurate, current, and complete information
• Maintain and promptly update your account information
• Keep your password secure and confidential
• Accept responsibility for all activities under your account
• Notify us immediately of any unauthorized access

You must be at least 16 years old to create an account and use the Service.

Subscription and Payments

Billing

• Subscriptions are billed in advance on a monthly or annual basis
• You authorize us to charge your payment method on each billing cycle
• All fees are non-refundable unless otherwise stated
• Prices are subject to change with 30 days' notice

Free Trial

We may offer a free trial period. At the end of the trial, your account will automatically convert to a paid subscription unless you cancel before the trial ends.

Cancellation

You may cancel your subscription at any time through your account settings. Cancellation will take effect at the end of your current billing period. You will retain access to the Service until then.

Acceptable Use Policy

You agree not to use the Service to:

• Violate any applicable laws or regulations
• Spam, harass, or send unsolicited messages
• Impersonate any person or entity
• Post content that is defamatory, obscene, or offensive
• Infringe on intellectual property rights
• Distribute malware or engage in phishing
• Attempt to gain unauthorized access to systems
• Interfere with or disrupt the Service
• Scrape or collect data without authorization
• Violate the terms of service of connected platforms
• Create fake accounts or engage in inauthentic behavior
• Use automated systems (bots) to inflate engagement metrics

Third-Party Platform Terms

Your use of the Service in connection with third-party social media platforms (Twitter, LinkedIn, Instagram, Facebook, etc.) is subject to the terms and policies of those platforms. You are responsible for complying with all applicable third-party terms.

We are not responsible for any actions taken by third-party platforms, including suspension or termination of your accounts on those platforms.

Intellectual Property Rights

Our Content

The Service and its original content (excluding user content), features, and functionality are owned by PostZen and are protected by copyright, trademark, and other intellectual property laws.

Your Content

You retain ownership of all content you create or upload to the Service. By using the Service, you grant us a limited license to use, store, and process your content solely to provide the Service.

AI-Generated Content

Content generated by our AI features is provided for your use. You are responsible for reviewing and approving all AI-generated content before publication. We make no guarantees about the accuracy or appropriateness of AI-generated content.

Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, POSTZEN SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, USE, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.

Our total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, secure, or error-free, or that any defects will be corrected.

Indemnification

You agree to indemnify, defend, and hold harmless PostZen and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service, your violation of these Terms, or your violation of any rights of a third party.

Termination

We may terminate or suspend your account and access to the Service immediately, without prior notice or liability, for any reason, including but not limited to a breach of these Terms.

Upon termination, your right to use the Service will immediately cease. You may request a copy of your data within 30 days of termination by contacting support@postzen.io.

Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of California, United States, without regard to its conflict of law provisions.

Any disputes arising from these Terms or your use of the Service shall be resolved through binding arbitration in San Francisco, California, in accordance with the rules of the American Arbitration Association.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the new Terms on this page and updating the "Last updated" date.

Your continued use of the Service after any changes constitutes acceptance of the new Terms.
